As interpreted by Pattee, von Neumann’s Theory of Self-Reproducing Automata has proved to be a useful tool for understanding some of the difficulties and paradoxes of molecular biosemiotics. But is its utility limited to molecular systems or is it more generally applicable within biosemiotics? One way of answering that question is to look at the Theory as a model for one particular high-level biosemiotic activity, human language. If the model is not useful for language, then it certainly cannot be generally (...) useful to biosemiotics. Beginning with the Universal Turing Machine and continuing with von Neumann’s Theory and Pattee’s interpretation, the properties of universality, programmability, underspecification, complementarity of description/construction, and open-ended evolutionary potential are shown to be usefully applicable to language, thus opening a new line of inquiry in biosemiotics. McAdams, "The Aesthetics of Light: A Critical Examination of (...) Bonaventure's Doctrine of Light in View of His Aesthetics," [PhD diss., Pontifica Universitas Gregoriana, 1991]). Heartily welcome, then, is Thomas McKenna's Bonaventure's Aesthetics. The purpose of the book, in McKenna's words, is "to provide a comprehensive analysis of Bonaventure's aesthetics, that is, his philosophy, theology, and mystical theology" (2). In so doing, he intends also to argue for a resolution to a list of disputed questions raised by contemporary voices – most famously that of Balthasar – in the debate on Bonaventure's aesthetics. Put another way, McKenna's project has two aims: first, to understand Bonaventure's aesthetics on its own (historical, theological, philosophical) terms; second, to determine whether that aesthetic connects significantly to contemporary questions in the field of aesthetics. In this review I will detail and engage critically with some of the foundational methodological moves McKenna makes in the book's introduction. I will then summarize the big themes of the book's four chapters, and conclude with a few evaluative remarks.However extensive their merits, earlier studies on Bonaventure's aesthetics are not as thorough as McKenna's and, more problematically, are limited by their investment in predominantly Enlightenment-era concerns. What I mean is that thinkers such as Shaftesbury, Baumgarten, and Kant were absorbed with matters such as the immediacy of the aesthetic experience, disinterest, the role of the affect, freedom of the imagination, and the categorization of les beaux arts. It is this trajectory (call it "the standard paradigm," using McKenna's terminology) that the field of aesthetics, as we know it, has largely followed. Early historians of aesthetics viewed, and often evaluated, medievals through the standard paradigm. Even later, more revisionist historical work sought to understand medieval thought in distinction from the paradigm. In most instances, [End Page 243] though, it is the Enlightenment-era list of concerns that serves as the fulcrum on which historical work has tended to swing. Our understanding of Bonaventure, then, is limited to the extent that we take the standard paradigm as guide.Bonaventure's Aesthetics is so compelling, in part, because it does not begin with the standard paradigm, but rather a more historically sound (and frankly, more interesting) list of research questions. This is not to say that McKenna rejects the standard paradigm. It is simply too deeply embedded in how we conceive of such matters to naively ignore. McKenna realizes that he faces a difficulty at this juncture, one that must be addressed by anyone aiming for historical sensitivity regarding their object of study. The difficulty is what McKenna calls "the hermeneutical crisis," and he formulates the key issues by quoting Jean Grondin: "The basic doctrine…is that every particular phenomenon must be conceptualized within the context of its age" to avoid anachronism. But if so, this "raises a striking epistemological problem…Our view of earlier ages must itself be produced by reference to our present, and is thereby relativized." He begins with a review of Catholic social teaching, and considers how this perspective is shaping Catholic thought and action regarding health care management and public policy reform. The paper is a response to Richard De George's essay, Theological Ethics and Business Ethics. It defends the possibility of theologically oriented approaches to business ethics by pointing out certain deficiencies in business ethics narrowly based on the premisses of analytic moral philosophy. In particular it argues, in a manner consistent with Alasdair MacIntyre's After Virtue (1981), that such a program of business ethics is insufficiently critical of its own roots in the social fiction of bureaucratic rationality. Ernst Troeltsch's essay on socialism presents a summary account of his views on the prospects for a socialist economic order within the Weimar Republic. Troeltsch attempts to formulate a compromise that incorporates the proposals of both social conservatism and communism. Such a compromise, he insists, is possible on the basis of a realistic assessment of socialism supported by "an act of faith in the future" based upon explicitly religious resources. The author attempts to show that Kant has not established the necessity of thinking human freedom in the theoretical sphere as would seem to be demanded by the inner logic of the first Critique and by the concept of autonomy in the second Critique.

Chinese philosophers today are challenged to make sense of faith in God, and particularly Christian faith as expressed by Chinese Christians, as an existential affirmation centering their personal and social lives. I offer here a philosophical approach to Christian faith, based upon interpretations of Søren Kierkegaard's work, Sickness unto Death. Kierkegaard's phenomenology of Christian conversion helps us understand and evaluate the recently obtained testimonies of 37 Hong Kong Chinese Christian business executives. Our study reveals not only what Christian faith means (...) to our informants, but also how Kierkegaard's interpretations are helpful in attempting a philosophical analysis of their testimonies. This essay explores the imaginative foundations of ethics, not by presenting a theory about the moral imagination, but by reconstructing the hermeneutic strategy underlying Reinhold Niebuhr's proposal for "an independent Christian ethic." The thesis is that Niebuhr's ethic cannot adequately be evaluated without careful attention to his hermeneutics, what he described as "the mythical method of interpretation." This point is argued first, by reconstructing Niebuhr's hermeneutics; second, by showing how his hermeneutics determines the strategy of his ethics; and third, by (...) using this focus to clarify certain issues separating Niebuhr and some of his recent critics, specifically, William Frankena's criticism of his metaethics, Gene Outka's objections to his normative ethic of love as self-sacrifice; and John Howard Yoder's rejection of the strategy of his Christian realism as a whole. The essay is presented in the hope that Niebuhr's example will encourage American religious ethicists to explore the relationship between hermeneutics and ethics with greater intellectual sympathy and theoretical sophistication. The example of Niebuhr's "independent Christian ethic" is commended as one attempt to map the formal and substantive ways in which religious visions help shape our dispositions and moral choices. For the past five years at the Daniels College of Business at the University of Denver a community service or service learning component has been included in the Values in Action class (now Values-Based Leadership), a core MBA course that integrates ethics, law, and public policy perspectives on business issues. This paper summarizes the educational philosophy and the mechanics of this required component. Few empirical studies have been conducted to gauge the perceived value and impact of a service learning requirement (...) on students. Thus, several surveys were conducted to understand better the choices made by students as well as the impact of the requirement on students. Preliminary results reveal generally a positive effect on students, including some evidence that such a service learning requirement may influence students to make a greater lifetime commitment to community service. This paper documents the types and amounts of aid exchanged between adults and their non-coresidential parents. Data for the study are drawn from a representative national sample survey of Americans age 19 and older conducted in 1987–1988. Exchanges of monetary and material resources, childcare, household assistance, and companionship and advice are considered.Patterns of intergenerational exchange are found to differ by gender, family structure, age, ethnicity, and socioeconomic situation. Differences in exchange between males and females and between whites and Mexican-Americans are (...) related to other life-course characteristics, and to the availability and proximity of kin. Blacks and persons living in poverty are shown to be less involved than other groups in intergenerational exchanges. Finally, patterns of prior assistance and the available needs and resources of the respondents and their parents are found to influence current patterns of exchange. (shrink)

Does Christian faith matter in business? If so, how does it affect the way executives handle managerial issues, especially the ones that are ethically controversial? This paper reports a study of Chinese Christian executives in Hong Kong. The researchers followed an approach known as the Critical Incident Technique and conducted in-depth interviews with 119 Chinese Christian executives over a two year period from 1999 to 2001. Each interview covered four broad areas consisting of the interviewee''s description of his or her (...) Christian faith, business experience, reported critical incidents and general remarks on faith and work. For each reported critical incident, the interviewee deliberated on the incident and its background, his or her response, the rationale behind the response and its consequences. Each interview was tape recorded for transcription and analysis. The major contribution of this study is to propose and document a typology of the executives'' responses to ethical challenges in business. The typology is based on earlier work on Christ and culture and styles of negotiation. Preliminary research findings indicate that the proposed typology is an effective paradigm. It has the promise of enabling Christian executives to reflect critically on their ethical behavior and to guide their thought towards more effective responses to ethical challenges. (shrink)

My conviction is that the type of agrarian planning based on upper-class conceptions of investment and profit played a fundamental role in shaping the Roman economy as a whole.... In this study, I propose to address this problem by analyzing the assumptions that the Roman jurists in the Digest of Justinian and in other classical sources made about investment and profit in agriculture as they addressed legal issues involving private property. I base my analysis on the legal sources because, as I shall demonstrate, they offer a more comprehensive picture of the economic interests of upper-class Romans than we can gain from other types of evidence, including literary evidence, documentary papyri, and inscriptions” (vii).The author’s awareness of the problems in using legal evidence to shed light on larger issues and his openness about his own assumptions and about the limitations of the methods and the sources he has chosen to employ are among the work’s great strengths. The work opens with an examination of the legal sources as evidence. Their condition offers one problem. The writings of the late Republican and early Imperial jurists are preserved largely in relatively brief citations included in the great collections of the sixth-century a.d.: Justinian’s Digest and Code. As Kehoe notes, this presents a major problem for investigators: to what extent do these passages represent the original—that is, was obsolete material removed systematically, and were the passages adjusted to fit the compilers’ concerns? Following authorities such as M. Kaser and F. Wieacker, the author takes an optimistic view of the matter, suggesting that “contemporary scholarship is justified in moving away from the suspicion that the Digest is so thoroughly interpolated that the opinions of the classical jurists can only be recovered after exhaustive reconstruction of the texts” (9). Classic studies of explanation, such as those of Hempel and Bromberger, took it for granted that an explanation-seeking question of the form "Why P?" should be understood as asking about the proposition P. This view has been recently challenged by Bas van Fraassen and Alan Garfinkel. They acknowledge that some questions have the surface form "Why P?", but they hold that a correct reading for why-questions should take the form "Why P (rather than Q)?", where Q is a contrasting alternative. Background: Although genetic research into Alzheimer disease (AD) is increasing, the ethical aspects of this kind of research and the differences between ethical issues related to genetic and non-genetic research into AD have not yet received much attention. Objectives: (1) To identify and compare the five ethical issues considered most important by surveyed expert panellists in non-genetic and genetic AD research and (2) to compare our empirical findings with ethical issues in genetic research in general as described in the literature. (...) Method: A modified Delphi study in two rounds Results: Genetic and non-genetic research into AD generated an approximately equal number of topics with a considerable overlap. Different priorities in the ethics of both types of research were found. Genetic research raised new topics such as “confidentiality of genetic information” and “implications of research for relatives” which changes the impact and application of existing ethical topics such as “informed consent” and is judged to have more impact on both individuals and society. A difference with the results of more theoretical approaches on ethical aspects related to AD research was also found. Conclusions: Different priorities are given to ethical issues in genetic and non-genetic research. These arise partly because genetic research causes unique and new questions, mostly related to the position of family members and the status of and access to genetic information. Differences found between the results of our empirical study and the more theoretical literature, suggest an additional value for empirical research in medical ethics. (shrink)

In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. The purpose of research is the identification and development of new generalizable knowledge. Thus, participation in a research study or trial may not benefit the study volunteer at all. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Presently, despite the risks borne by the research study participant, the raw data collected from volunteers in research trials are treated by courts as if they were the private property of the study sponsor rather than generally owed to the public as would be expected by an effort like research participation aimed at contributing to the development of generalizable knowledge. Seminar/project Idea Draw a timeline of the development of the basic concepts of consent and informed consent in patient care and in patient research. On this timeline, first place the dates of the key court cases in England, the United States, Canada, and Australia on consent and informed consent. Then place the date of the development of the Belmont Report. Why do differences exist between these four countries in terms of the legal requirements of informedness of a patient (in medical care) and a study participant (in medical research)? What roles if any do the concepts of self‐determination and self‐decision have in consent and informed consent in patient care and in informed consent in research on humans among the four countries of interest? What are the realities of research on human participants that require a new standard of informed consent, the reasonable volunteer standard, to be developed beyond the two standards in patient care, the professional standard, and the reasonable person standard? Counterpoint Arguments The following are counterpoint arguments that need to be appreciated to more fully understand the concepts that impact the thesis that ‘raw data’ should be open to the public to allow the opportunity of checking of the results of its associated scientific paper and for further analysis. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. Gene therapy approaches have great promise in the treatment of neurodegenerative disorders and malignant brain tumors. Neuwelt et al. review available viral-mediated gene therapy methods and their blood-brain-barrier (BBB) disruption delivery technique, briefly mentioning nonviral mediated gene therapy methods. This commentary discussed the BBB disruption delivery technique, viral and nonviral mediated gene therapy approaches to Parkinson's disease, and the potential use of antisense oligo to suppress malignant brain tumors.

In “Divine Foreknowledge and Facts” Paul Helm defends a traditional argument to the incompatibility of foreknowledge and free will “against the attempts of Kenny and some other recent writers to provide a reconciliation.” I shall here set out a reconciliationist position similar to those he attacks, but innocent of the charges he makes against them.The argument, discussed by St. Thomas in the Summa Theologiae, employs the doctrine of the necessity of the past to show that literally prior knowledge of a (...) free action is impossible. Since prior knowledge of an action is past relative to the ·action, the fact of that knowledge is necessary. It is a past fact, and so cannot be undone. From this it follows that the action itself must be necessary; for necessity is transitive, and knowledge of p implies p. pThis article seeks to demonstrate how a dialogue between literary theorist and psychoanalyst François Flahault and Kyoto School philosopher Nishida Kitarō can be mutually beneficial in the service of building an account of good and evil that contributes to discourses in ethics. Although Flahault and Nishida share a similar commitment to disrupt the dichotomy between good and evil in the effort to liberate subjectivity, they diverge in terms of how their accounts relate subjectivity to the processes of social history. As (...) this article will discuss, the significance of their divergence, however, elucidates the strengths and limits of their approaches to the victim-victimizer duality that is implied within the problem of good and evil. Such a divergence also points to a potential space of synthesis and mutual enrichment as well: namely, on the side of championing Nishida’s contradictory logic and Flahault’s emphasis on the contextual demands and problems of social history. That is to say, within the dialogical encounter between Flahault and Nishida, as the present article suggests, is the potentiality to develop a universal conception of the common good that is contradictorily linked to the subjective interior where such provides a critical resource for a deeper engagement with the victim-victimizer duality./p.
